“The act of tweaking the script of the transparency server caused widespread anxiety and concern amongst the nation.

The lapses in protocol have undermined the credibility and integrity of the 2016 elections,” sabi ni Jonathan dela Cruz.

Kinasuhan ni Dela Cruz sa Comelec sina Marlon Garcia, head ng Smartmatic Technical Support Team; Elie Moreno, project director ng Smartmatic; Neil Banigued, miyembro ng Smartmatic Technical Support Team; at Rouie Peñalba, IT officer ng Comelec.

Sa kanyang 14 na pahinang complaint-affidavit, sinabi ni Dela Cruz, na kinatawan ng Abakada Party-list sa Kongresom na nilabag ng apat ang Section 35 ng RA 8436, na inamyendahan ng RA 9369 (Poll Automation Law) na nagsasaad na “by interfering with, impeding, absconding for purpose of gain, preventing the installation or use of computing counting devices and the processing, storage, generation and transmission of election returns, data or information.”

Kinasuhan din ang apat sa paglabag sa Section 35 (c) ng AES Law “by gaining or causing access to, using, altering and destroying computer data, program and system software, network, or any computer-related devices, facilities, hardware or equipment, whether classified or declassified.”

Nilinaw ni Dela Cruz na hindi layunin ng reklamo na mag-akusa ng pandaraya kundi nais lamang ilabas ang katotohanan tungkol sa pagpapalit ng script sa transparency server. (Leslie Ann G. Aquino)
