Pinababaligtad ng prosekusyon ng Office of the Ombudsman sa Sandiganbayan ang nauna nitong desisyon na nagpapahintulot na makapagpiyansa sina dating APEC Party-list Rep. Edgar Valdez at Janet Lim Napoles kaugnay ng umano’y maanomalyang paggamit sa Priority Development Assistance Fund (PDAF).
Nanindigan ang Office of the Special Prosecutor (OSP) ng anti-graft office na dapat na maibalik sa piitan sina Valdez at Napoles dahil matibay ang mga ebidensiyang iprinisinta ng prosekusyon upang tanggihan ang pagpipiyansa ng dalawa.
Sa kanilang mosyon, iginiit ng OSP na ang “participation was not limited to project identification but extended to the implementation stage.”
Ayon pa sa prosekusyon, ang ginawa ng non-government organization (NGO) na “selection process through competitive public bidding was ignored” and is a “clear deviation from the regular process to unduly influence and exert pressure on the implementing agencies (IAs) to omit the established legal parameters.”

Batay sa mga ebidensiya ng prosekusyon, mula 2004 hanggang 2010 ay nilagdaan ni Valdez ang mga endorsement letter at nagsumite ng listahan ng mga prioridad na proyekto at budget na inilaan para rito, tinukoy ang mga IA at mga NGO, kaya naipalabas ang PDAF ng kongresista.
Tinukoy ang report ng Anti-Money Laundering Council (AMLC) na nagkumpirma sa pagbabayad ng mga kickback at komisyon ni Valdez, sinabi pa ng OSP na “Valdez received from JLN or NGOs/foundations used by JLN as conduit to implement the supposed PDAF projects, a total amount of P50,290,810.” (Jun Ramirez)
