Ibinasura ng Quezon City court ang kasong obstruction of justice ng National Bureau of Investigation (NBI) laban kay Marlene Aguilar-Pollard, kapatid ng folk singer na si Freddie Aguilar at ina ng convicted road rage killer na si Jason Ivler, dahil sa kakulangan ng ebidensiya.
Nakasaad sa pitong pahinang kautusan ni Judge Juvenal Bella ng Metropolitan Trial Court Branch 39, na ibinasura ang kaso dahil ang criminal offense ay batay sa positibong katibayan at hindi sa palagay lamang.
“Inferences and presumptions cannot substitute for proof beyond reasonable doubt,” ayon kay Bella.
Enero 19, 2010 nang kasuhan ng NBI ng obstruction of justice si Aguilar dahil sa umano’y tangkang pakikialam at pagpigil sa kanilang pag-aresto kay Ivler noong Enero 18, 2010 sa bahay nito sa Barangay Blue Ridge A, Quezon City.
