Pinapasampahan na ng kasong graft sa Sandiganbayan si Mayor Jenny De Asis ng San Francisco, Agusan del Sur, at tatlong iba pa, kaugnay ng umano’y maanomalyang pagbili ng generator set noong 2004.

Bukod kay De Asis, pinakakasuhan din sina Municipal Engineer Cesar Yu, Supply Officer Jovito Torrero at Municipal Accountant Evelyn Damasco.

Ayon sa resolusyong pirmado ni Ombudsman Conchita Carpio Morales, nilabag ng mga ito ang Section 3(e) ng Republic Act 3019 (Anti-Graft and Corrupt Practices Act).

Sa isinagawang imbestigasyon ng Ombudsman, inaprubahan umano ni De Asis ang pagbigli ng generator set na gagamitin bilang standby power source para sa nabanggit na bayan noong Pebrero 2004.

“Records show that three price quotations were secured by the municipality, with RAS Heavy Equipment from Quezon City supposedly submitting the lowest price quotation of P760,000. However, upon audit, the Commission on Audit (CoA) found out that there was no actual bidding done before the purchase and that the purchased item was overpriced,” pahayag ni Morales.

Isa pa sa kinuwestiyon ng CoA ay ang pagbabayad ng cash ng nasabing bayan na salungat sa standard procurement practice na tseke ang dapat na ibayad.

Tinukoy din ni Morales na hindi nagkaroon ng competitive bidding, na nagsisilbing standard mode of procurement sa lahat ng procuring entities, sa pamahalaan at ang pag-aapruba at pagbasura sa mga in-award na kontrata ay nakasalalay din sa Head of the Procuring Entity (HOPE).

Ayon kay Morales, nagsisilbing HOPE ng bayan si De Asis dahil siya ang alkalde sa lugar.

“As the municipality’s HOPE, it was her duty to insure that all procurement activities in the local government unit were undertaken in full compliance of the law,” pagdidiin pa ni Morales. (Rommel P. Tabbad)
