Magkahiwalay na naglabas ng desisyon ang dalawang sangay ng Sandiganbayan na nagbabasura sa kahilingan nina Senators Ramon “Bong” Revilla Jr. at Jose “Jinggoy” Estrada na mabisita ang burol ng kanilang yumaong kaibigan na si German “Kuya Germs” Moreno.

Naglabas ng magkahiwalay na resolusyon ang First at Fifth Division ng anti-graft court na nagbabasura sa hiling ng dalawang senador na pansamantalang makalabas sa piitan upang makapunta sa burol ni Kuya Germs sa Mt. Carmel Church sa New Manila sa Cubao.

Nais ni Revilla na payagan siyang makapunta sa Mt. Carmel Church mula 3:00 ng hapon hanggang 8:00 ng gabi, habang si Estrada ay mula 7:00 hanggang 10:00 ng gabi.

“Accused-movant, being a detention prisoner, cannot be accorded the full enjoyment of his civil or political rights as a necessary consequence of his detention,” saad sa resolusyon ng Fifth Division hinggil sa mosyon na inihain ni Estrada.

“Suffice it to state that to allow the accused-movant to leave his detention cell, especially at this time when the Court already denied his petition for bail, will not only set a bad precedent but will likewise be regarded as a mockery of the administration of justice,” ayon sa resolusyon na nilagdaan ni Fifth Division Chairman Roland Jurado at nina Associate Justices Ma. Theresa Gomez-Estoesta at Sarah Jane Fernandez.

Enero 7 nang naglabas ng resolusyon ang Fifth Division na nagbabasura sa petition for bail na inihain nina Estrada at Janet Lim Napoles, na itinuturong utak ng multi-bilyong pisong pork barrel scam.

“After weighing the arguments of the parties, the Court is of the view that the situation presented by the accused could not be considered a special circumstance that deserves exception to the general restrictions on a detention prisoner’s rights. Thus, the motion is denied,” nakasaad naman sa desisyon ng First Division hinggil sa mosyon na inihain ni Revilla.
