Inihain sa Commission on Elections (Comelec) ang ikatlong petisyon na humihiling na kanselahin ang certificate of candidacy (CoC) ni Davao City Mayor Rodrigo Duterte bilang pangulo.
Sinabi ng petitioner na si John Paulo delas Nieves na invalid ang CoC ni Duterte dahil hindi tunay na kandidato ang CoC na kanyang pinalitan.
“There was no bonafide candidate that the respondent could validly substitute for. Martin Diño was not a bonafide candidate within the contemplation of our election laws,” saad sa petistyon.
“Respondent Duterte filed a substitute CoC for the position of president which is different from the position stated in the withdrawn CoC of the candidate he is supposedly substituting for,” pagpapatuloy nito.

Magugunita na inilagay ni Diño sa kanyang CoC na siya ay tumatakbong mayor ng Pasay City at hindi pangulo.
Noong Nobyembre 27, naghain si Duterte ng kanyang CoC para pangulo bilang kapalit ni Diño ng partidong PDP-Laban. - Leslie Ann Aquino
