Nahaharap ngayon sa kasong graft sa Sandiganbayan ang tatlong dating opisyal ng Department of Education (DepEd) sa Tagum City, Davao del Norte dahil sa umano’y maanomalyang pagbili ng 32 unit ng cellular phone noong 2007.
Ito ay makaraang iutos ng Office of the Ombudsman na kasuhan na ang mga ito ng paglabag sa Anti-Graft and Corrupt Practices Act.
Sa 6-pahinang resolusyon na pirmado ni Deputy Ombudsman for Mindanao Rodolfo Elman, kasama sa pinakakasuhan sina dating DepEd-Tagum City Schools Division Superintendent Aurora Cubero at Salvacion Yumang, gayundin si dating Administrative Officer Emma Betonio.
Lumabas sa imbestigasyon ng anti-graft agency na minadali ng mga ito ang pagbili ng nasabing mga unit ng mobile phone sa pamamagitan ng cash advance noong Nobyembre 2007, at idinahilan ng mga ito sa pagbili ang “exceptionally necessary and indispensable” para sa opisyal na paggamit sa mga ito.
“Under the procurement rules, the prevailing threshold for shopping of unforeseen contingency items requiring immediate purchase was only P50,000 while the threshold for purchase of ordinary or regular office supplies and equipment not available in the procurement service was only P250,000. There is no showing that the cellular phones are ordinary or regular office supplies as contemplated in procurement laws,” saad sa resolusyon ng Ombudsman.
