Pinakakasuhan ng Quezon City Prosecutors’ Office ang aktor na si Cesar Montano bunsod ng pananakit umano nito sa kanyang asawa na si Sunshine Cruz noong 2009 hanggang 2013.

Sa apat na pahinang resolusyon, sinabi ni Assistant City Prosecutor Mary Jean Cajandab-Pamittan na may sapat na basehan upang kasuhan si Montano ng three counts ng paglabag sa Section 5 (a) ng RA 9262 o Anti-Violence Against Women and Children Act noong Hulyo 2009, Enero 2013 at Mayo 2013.

Sinabi ni Pamittan na napagtibay ni Cruz na sinaktan siya ni Montano sa tatlong nabanggit na petsa, sa pamamagitan ng mga larawan na isinumite ng aktres sa korte sa kabila ng kawalan ng medical certificate.

Subalit iginiit ni Pamittan na bigo naman si Cruz na patunayan na sinaktan siya ni Montano noong Pebrero 2013 at inatake at hinalay noong Mayo 12, 2013.

Wala ring nakalap na matibay na ebidensiya ang prosekusyon na magpapatunay na itinigil ni Montano ang suportang pinansiyal para kay Sunshine at sa tatlo nilang anak.

“Moreover, the issue of custody over the minor children is already settled matter in view of the amicable settlement of the parties,’’ ayon sa resolusyon.

“Anent the accusation that respondent verbally abused complainant repeatedly as shown by the text messages containing grave defamatory remarks and threats, we noted the same were exchanges of sentiments between the parties. While it is inarguable that the series of messages exchanged by them may have caused hurt and pain especially to the complainant, still, to our minds, the same does not give rise to respondent’s criminal liability under section 5 (1) of RA 9262,’’ saad sa resolusyon.
