Pinawalang-sala ng Court of Appeals (CA) ang dalawa pang opisyal ng Philippine National Police (PNP) na unang isinangkot sa umano’y maanomalyang pagbili ng tatlong helicopter na nagkakahalaga ng P104 milyon noong 2009 at 2010.

Sa desisyon na isinulat ni Associate Justice Elihu Ybañez, inabsuwelto ng CA sina Superintendents Roman Loreto at Emilando Villafurete sa kasong serious dishonesty at conduct prejudicial to the best interest of the service.

Ito ay matapos maghain ng petisyon sina Loreto at Villafuerte na humiling sa pagbasura sa desisyon ng Office of the Ombudsman noong 2012 na nagdeklarang guilty ang 12 opisyal ng pambansang pulisya sa dalawang nabanggit na kaso.

Noong 2013, pinawalang-sala ng appellate court si Chief Supt. Luis Saligumba na isinangkot din sa helicopter scam at agad na ipinag-utos na ibalik siya sa serbisyo.

Ayon sa CA, nagkamali ang Ombudsman nang ideklara nitong nakipagkutsabahan sina Loreto at Villafuerte upang dayain ang gobyerno sa pagbili ng mga segunda-manong helicopter na hindi naaayon sa requirement ng PNP.

“In the present case, no records will show that petitioners took part in the alleged conspiracy. They were not signatories of any document pertaining to the procurement of the three helicopters,” saad sa desisyon ng CA.

“The petitioners were neither part of the team which inspected the procured helicopters nor were they signatories in the disbursement vouchers for the payment of the said helicopters. Hence, there is no direct evidence that will link them to the alleged conspiracy,” dagdag pa ng korte.

Noong 2009 at 2010, bumili ang PNP ng isang fully-equipped Robinson R44 Raven II Light Police Operational Helicopter na nagkakahalaga ng P42.3 milyon, at dalawang standard Robinson R44 Raven I ng P62.6 milyon, o may kabuuang halaga na P104.9 milyon.
