Hiniling ng mga state prosecutor sa Sandiganbayan Fifth Division na huwag payagan si Senator Jose “Jinggoy” Ejercito Estrada na makadalo sa mga pagdinig sa Senado hinggil sa madugong engkuwentro sa Mamasapano, Maguindanao, na 44 na police commando ang napatay.

“Indeed, this matter should be thoroughly investigated to ferret out the truth,” pahayag ng prosekusyon hinggil sa petisyon ng senador na isinumite sa korte.

“Our existing laws, and jurisprudence prevents him from doing so; and the prosecution is duty-bound and constrained to vigorously oppose said request,” giit ng mga abogado ng gobyerno.

Ipinaliwanag din ng prosekusyon na ang kasong kinahaharap ni Estrada ay plunder, isang capital offense na walang piyansa.

Taliwas din kung papayagan ng Sandiganbayan Fifth Division si Estrada na makadalo sa pagdinig ng Mamasapano carnage sa Senado sa nakabimbin nitong hiling para makapagpiyansa.

Anila, maaari pa ring magdaos ng pagdinig ang ibang senador dahil may sapat pa ring quorum kahit pa hindi makadalo si Estrada.

“Considering that accused Estrada was not allowed by this Honorable Court to conduct committee hearings in his detention, it is with more reason that his present request to leave his detention cell to attend the investigation in the Senate, which involves a grant of temporary liberty prior to resolution of his bail petition, be not granted,” dagdag ng prosekusyon.

Kasalukuyang nakadetine si Estrada sa Philippine National Police (PNP) Custodial Center sa Camp Crame sa Quezon City matapos siyang isangkot sa multi-bilyon pisong pork barrel scam.
