Nakatikim ng sabon ang mga opisyal ng National Irrigation Authority (NIA) mula sa Commission on Audit (CoA) matapos mabigo ang una na makakuha ng performance at quality warranty para sa mga proyektong imprastruktura at irigasyon na ginastusan ng gobyerno ng milyun-milyong piso.

Base sa 2013 annual audit report para sa NIA, sinabi ng mga state auditor na hindi tumupad ang NIA sa RA 9184 o Government Procurement Act Relating to Warranties for Government Projects.

“The best interest of the government is not protected because the contractors of NIA projects that cost in hundreds of millions of pesos are released from any liability that may occur during the defects liability and warranty periods since they are not required to post performance and warranty security that would suppose to cover one year from project completion up to final acceptance of the projects and beyond for structural defects and failures,” saad sa CoA report.

Sa ilalim ng RA 9184, dapat may kaukulang warranty ang mga proyektong imprastruktura—mula sa petsa na sinimulan ang konstruksiyon hanggang isang taon matapos ang final acceptance ng proyekto.

Dapat ding akuin ng kontratista ang responsibilidad sa mga nasira o nawasak sa proyekto sa oras na sinimulan ito hanggang sa makumpleto.

Saklaw ng warranty ang mga depekto at kapalpakan sa trabaho ng 15 taon para sa mga permanent structure, limang taon para sa semi-permanent, at dalawang taon para sa ibang istruktura.

Nadiskubre ng CoA na walang warranty security ang mga natapos na proyekto ng NIA Regional Office IX na nagkakahalaga ng P248.81 milyon.
