Hindi dapat suwayin ng Anti-Money Laundering Council (AMLC) ang subpoena na ipinalabas ng Sandiganbayan hinggil sa imbestigasyon sa mga bank account ng mga whistleblower kaugnay sa multibilyong pisong pork barrel scam.

“Accordingly, as there are no valid ground for the AMLC to refuse honor the Subpoena Duces Tecum issued by the Honorable Court, the AMLC should be directed to immediately comply herewith,” pahayag ng mga abogado ni Sen. Jinggoy Estrada sa inihaing manifestation sa Sandiganbayan Fifth Division.

Unang iginiit ng AMLC na hindi ito maaaring pilitin na ilabas ang mga bank account ng mga whistleblower sa pork barrel anomaly bagamat nagpalabas na ng subpoena ang Sandiganbayan Fifth Division hinggil dito noong Nobyembre 21.

“The AMLC makes it appear that it has a choice on whether to comply or not with the Subpoena issued by the Honorable Court. Aside from the fact that the law gives no such discretion to the AMLC, there is no law allowing the AMLC to unilaterally decide as to Sen. Estrada’s constitutional right to confront the witnesses against him,” dagdag ng kampo ni Estrada.

Sinabi pa ng mga abogado ng senador na ipinipilit ng prosekusyon na ibinulsa ni Estrada ang pondo subalit ito ay taliwas umano sa katotohanan dahil ang mga bank account ang magpapatunay na napunta ang malaking komisyon sa anomalya sa kamay ng mga whistleblower.
