Kasabay ng pagtiyak na hindi makaaalis sa bansa si US Marine Private First Class Joseph Scott Pemberton at mabibigyanghustisya ang pagkamatay ni Jeffrey “Jennifer” Laude, sinabi kahapon ni Department of Foreign Affairs (DFA) Secretary Alberto F. Del Rosario na hindi siya tiyak kung papayag ang Amerika na maamyendahan ang 15 anyos na PH-US Visiting Forces Agreement (VFA) kasunod ng nasabing krimen sa Olongapo City.

“You can be sure Pemberton will not leave the country and justice (para sa pamilya Laude) will be served,’’ sinabi ni Del Rosario nang humarap siya, kasama ang iba pang opisyal ng DFA, sa pagdinig ng Senate finance sub-committee, na pinamumunuan ni Senator Loren Legarda, upang idepensa ang panukalang P12.8 bilyon budget ng kagawaran para sa 2015.

“We intend to show the public that the VFA works and justice will be served,” sabi ng kalihim.

Nang tanungin ni Legarda kung maaaring amyendahan ang VFA, sinabi ni Del Rosario: “I am not sure the US will agree.”

Gayunman, pinag-aaralan na ng mga opisyal ng DFA at mga opisyal mula sa Amerika ang VFA simula pa noong nakaraang taon.

“We are reviewing the VFA in its entirety to see how we can fine it. The sticky points are: jurisdiction, the custody (ng mga nagkasalang sundalo, gaya sa kaso ni Pemberton); and official duty. We are looking at all of those,” sinabi ni Del Rosario sa mga Senate reporter.

Sa usapin ng kostudiya, sinabi ni Del Rosario kay Legarda na “legal custody remains with the US and in the case of Pemberton we have requested for custody in terms of the extraordinary situation we are in.’’

Nakadetine ngayon si Pemberton sa Camp Aguinaldo at ang “US has custody but he is in Philippine property in the military base and security is being provided by both the Philippines and the US,’’ sabi ni Del Rosario.

Inamin din ng kalihim na “technically speaking” ay hindi hiniling ng Pilipinas ang kostudiya kay Pemberton “because Pemberton has not been charged”.

Nang tanungin kung kailan makakasuhan sa korte si Pemberton, sinabi ni Del Rosario na “we will formally ask and we said that we will be formally asking.”

PAGBASURA SA VFA, PINABORAN

Samantala, dumarami ang sumusuporta mula sa Kongreso sa panawagang ibasura ang VFA, at si Valenzuela City Rep. Sherwin Gatchalian, miyembro ng House majority, ang huling nakiisa sa hakbanging anti-VFA sa Mababang Kapulungan.

“This is an opportunity for the government to prove its loyalty to the Filipino people by abolishing the VFA and by making sure that the accused will be placed under the jurisdiction of Philippine laws,” sabi ni Gatchalian, miyembro ng House Committee on Foreign Affairs.

Sinabi ni Kabataan Partylist Rep. Terry Ridon, mula sa oposisyon, na maraming kongresista ang nagpapahayag ng suporta para sa isang multi-party bid na magwawakas sa kasunduang anila’y nakapanig lang sa interes ng Amerika.
